EPFO Under Fire for Pension Recovery Demands, High Court Stay Ignored

The Employees’ Provident Fund Organisation (EPFO) in Kannur, Kerala, has issued notices to several pensioners demanding the repayment of alleged excess pension amounts. These demands have caused significant unrest among retirees, especially since many of them had secured a stay from the Kerala High Court against such recovery actions. Despite the legal protection, EPFO has withheld pension payments to some, raising serious questions about due process and contempt of court.

The issue stems from recent changes in pension calculation guidelines. Following a Supreme Court verdict that clarified eligibility for higher pension based on actual salary contributions, EPFO revised its interpretation of past payments. They now claim that some pensioners received more than what they were entitled to under the new calculations, and are asking them to repay the difference.

Affected pensioners include many who had earlier opted for higher pension contributions based on their full salary and had also received the appropriate benefits as per older interpretations. These individuals argue that they were granted higher pension amounts through proper legal procedures, including favorable judgments from the Kerala High Court. In light of those rulings, pensioners say the current EPFO actions directly violate court orders.

Moreover, the pensioners claim that they are being unfairly targeted, as no thorough audits or individualized assessments were conducted before issuing these demands. The blanket approach of issuing repayment notices and halting pension disbursals without proper investigation has led to widespread confusion and distress.

Some retired individuals have not only had their monthly pensions stopped, but have also been issued recovery notices amounting to lakhs of rupees. Many of them are dependent solely on these pensions for their livelihood. The unexpected stoppage has caused financial hardships, especially among the elderly who are not in a position to repay such large sums or pursue prolonged legal battles.

Legal experts have criticized EPFO’s actions, pointing out that ignoring a High Court stay order could be considered contempt of court. Retirees and their legal teams are now exploring the possibility of initiating contempt proceedings against the EPFO officers responsible. The matter has also sparked concern among other pensioners across Kerala and beyond, who fear similar actions may be taken against them.

Despite appeals and representations, EPFO has not offered clear communication or resolution pathways. This lack of transparency has further escalated tensions. Many pensioners have now come together to demand a review of the actions and a halt to further recovery attempts until the courts provide a final ruling on the matter.

The controversy highlights the larger issue of inconsistent implementation of pension rules across India and the challenges retirees face when administrative bodies bypass legal safeguards. With mounting pressure and legal threats looming, the EPFO may soon have to provide official clarification or face judicial scrutiny.
