New Delhi: The Delhi High Court has granted strong legal protection to Bollywood actor Aishwarya Rai Bachchan by safeguarding her personality rights. The court ruled that any unauthorized use of her name, image, voice, or likeness for commercial purposes without her consent is a violation of her right to live with dignity under Article 21 of the Constitution.
Justice Tejas Karia restrained multiple entities from misusing the actor’s personal attributes to promote products, services, or other commercial ventures. The court observed that such actions not only result in financial losses but also damage her reputation, dignity, and goodwill.
The order stated:
“Any infringement of the Plaintiff’s personality rights, while causing confusion amongst the public regarding endorsement or sponsorship of a product or service by the Plaintiff, will also lead to dilution of the Plaintiff’s reputation and goodwill.”
Recognizing her stature, the court noted that Aishwarya Rai Bachchan is one of India’s most celebrated entertainment personalities, widely respected for her brand associations and endorsements. “She has garnered immense goodwill such that members of the public repose their trust in the brands endorsed by her,” Justice Karia said.
This ruling strengthens the legal framework protecting celebrities and public figures against unauthorized exploitation of their identity across advertisements, merchandise, and digital media. It also reinforces that personality rights are closely tied to an individual’s fundamental right to life and dignity.
